1. Acceptance of Terms

By accessing or using HireAIReceptionist.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. HONNYDO LLC ("Company," "we," "us," or "our") reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

HireAIReceptionist.com provides an AI-powered virtual receptionist service that answers business phone calls, books appointments, handles frequently asked questions, and provides call summaries. The Service is powered by third-party AI voice technology (ElevenLabs) and telephony infrastructure (Twilio). We do not guarantee that the Service will be error-free or uninterrupted.

3. Account Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must be at least 18 years old to use this Service. By creating an account, you represent that all information you provide is accurate and current.

4. Subscription and Payment

The Service is offered on a subscription basis. By selecting a paid plan, you agree to pay the applicable subscription fees. Fees are billed monthly or annually depending on your selected plan. All fees are non-refundable except as required by law or as stated in our 7-day money-back guarantee for new subscribers. We reserve the right to change our pricing with 30 days notice. Failure to pay may result in suspension or termination of your account. Payments are processed by Stripe, Inc.

5. Cancellation and Refunds

You may cancel your subscription at any time from your dashboard. Cancellation will take effect at the end of your current billing period. You will not receive a refund for any unused portion of your subscription except within the first 7 days of your initial subscription, where you may request a full refund by contacting hello@hireaireceptionist.com. After 7 days, no refunds will be issued.

6. Use of the Service

You agree to use the Service only for lawful business purposes. You may not use the Service to: (a) violate any applicable law or regulation; (b) impersonate any person or entity; (c) engage in any deceptive or fraudulent activity; (d) transmit any unlawful, harassing, defamatory, obscene, or otherwise objectionable content; (e) interfere with or disrupt the Service or servers connected to the Service; (f) attempt to gain unauthorized access to any portion of the Service. We reserve the right to terminate accounts that violate these terms.

7. Call Recording and Transcription

The Service records and transcribes phone calls handled by your AI receptionist. By using the Service, you agree to comply with all applicable laws regarding call recording and disclosure in your jurisdiction. In many states and countries, you are required to inform callers that their call may be recorded. You are solely responsible for compliance with such laws. We provide call recordings and transcriptions solely for your business use and do not claim ownership of this content.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of HONNYDO LLC. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of HONNYDO LLC. You retain ownership of all content you provide to configure your AI receptionist, including business information, FAQs, and greetings.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the AI receptionist will handle all calls accurately or appropriately.

11. Limitation of Liability

To the fullest extent permitted by law, HONNYDO LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless HONNYDO LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.
